Gratitude is both expected and problematic in live organ donation. Are there grounds to require it, and to forbid access to live donor transplantation to a recipient who fails to signal that he feels any form of gratitude? Recipient gratitude is not currently required for organ donation, but it is expected and may be a moral requirement. Despite this, we argue that making it a condition for live organ transplantation would be unjustified. It would constitute a problematic and disproportionate punishment (...) for perceived immoral behaviour on the part of the recipient. It would also bar the donor from positive aspects of organ donation that remain even in the absence of recipient gratitude. A potential recipient's lack of gratitude should be explored as a possible symptom of other morally problematic issues and integrated into the information provided to the potential donor. Recognition of the donor's gift and gratitude for it may also need to be expressed in part by others. This last aspect is relevant even in cases where the recipient feels and expresses gratitude. In this paper, we argue that there are epistemic norms on evidence-gathering and consider consequences for how to understand epistemic normativity. Though the view that there are such norms seems intuitive, it has found surprisingly little defense. Rather, many philosophers have argued that norms on evidence-gathering can only be practical or moral. On a prominent evidentialist version of this position, epistemic norms only apply to responding to the evidence one already has. Here we challenge the orthodoxy. First, we argue that (...) there is no significant normative difference between responding to evidence you have and gathering more evidence. Second, we argue that our practices of epistemically criticizing agents for their poor evidence-gathering indicate the existence of epistemic norms on evidence-gathering. Bioethics emerged as a discipline in the 70s of the last century. One of its main objectives has been to analyze clinical cases that pose moral problems. This analysis is generally carried out by a multidisciplinary group, the Health Care Ethics Committee, which is comprised of ethical experts or healthcare providers assisted by a facilitator, depending on the context. Different methodologies are used in these situations. The deliberative method, in its various configurations, is the most widely used in many Committees. (...) Identify whether the deliberative method is included in regulated undergraduate and postgraduate teaching; analyze whether a single model can be identified or whether there is heterogeneity in the proposals. A bibliographic review was carried out, following the scoping review method. With respect to the first objective, there is no evidence on the teaching and use of the deliberative method in the Faculties and Schools of Medicine and Nursing, the emphasis is placed on training oriented to the resolution of clinical cases and a certain deliberative proposal is developed from them, more pragmatic than ethical-philosophical. In relation to the second objective, differences are observed between the two most prevalent schools (D. Gracia and B. Molewijk), with the model proposed by Gracia being used more in the Spanish-speaking world, and Molewijk's model in the English-speaking world. It can be seen that D. Gracia's proposal is more philosophical and Molewijk's more pragmatic. Finally, it is considered pertinent to further disseminate the deliberative method and its advantages, as well as its potential for bioethics education. (shrink)

¿Es Kant un sexista? La discusión contemporánea sobre el sexismo kantiano recorre todas las áreas del corpus desde la epistemología, metafísica, estética, ética hasta la filosofía política. En la presente investigación me concentraré en la discusión ética y política, en particular en el estatus moral de la mujer. Argumentaré que inclusive en la lectura más caritativa de Kant el estatus moral de la mujer es inferior al del hombre. Para desarrollar el punto anterior tomaré como hilo conductor el concepto de (...) carácter. Este concepto presenta dos ventajas. Por un lado, condensa ciertas preocupaciones morales como la relación entre sensibilidad y razón. Por otro lado, y en relación con el punto anterior, el carácter moral se expresa diferente en el carácter femenino y en el carácter masculino. En el primero se expresa el sentimiento, mientras que en el segundo se expresa la racionalidad. Dada la primacia de la racionalidad sobre sentimiento, el carácter moral masculino tiene ciertas ventajas sobre el femenino. (shrink)

Identity-protective reasoning---motivated reasoning driven by defending a social identity---is often dismissed as a paradigm of epistemic vice and a key driver of democratic dysfunction. Against this view, I argue that identity-protective reasoning can play a positive epistemic role, both individually and collectively. Collectively, it facilitates an effective division of cognitive labor by enabling groups to test divergent beliefs, serving as an epistemic insurance policy against the possibility that the total evidence is misleading. Individually, it can correct for the distortions that (...) arise from taking ideologically skewed evidence at face value. This is particularly significant for members of marginalized groups, who frequently encounter evidence that diminishes the value of their identities, beliefs, and practices. For them, identity-protective reasoning can counter dominant ideological ignorance and foster resistant standpoint development. While identity-protective reasoning is not without risks, its application from marginalized and counter-hegemonic positions carries epistemic benefits crucial in democracies threatened by elite capture. Against dominant views in contemporary political epistemology and psychology, identity-protective reasoning should be reconceived as a resource to be harnessed and not a problem to be eradicated. Delusions are deeply evidence-resistant. Patients with delusions are unmoved by evidence that is in direct conflict with the delusion, often responding to such evidence by offering obvious, and strange, confabulations. As a consequence, the standard view is that delusions are not evidence-responsive. This claim has been used as a key argumentative wedge in debates on the nature of delusions. Some have taken delusions to be beliefs and argued that this implies that belief is not constitutively evidence-responsive. Others hold fixed the (...) evidenceresponsiveness of belief and take this to show that delusions cannot be beliefs. Against this common assumption, I appeal to a large range of empirical evidence to argue that delusions are evidence-responsive in the sense that subjects have the capacity to respond to evidence on their delusion in rationally permissible ways. The extreme evidence-resistance of delusions is a consequence of powerful masking factors on these capacities, such as strange perceptual experiences, motivational factors, and cognitive biases. This view makes room for holding both that belief is constitutively evidence-responsive and that delusions are beliefs, and it has important implications for the study and treatment of delusions. The article evaluates the Domain Postulate of the Classical Model of Science and the related Aristotelian prohibition rule on kind-crossing as interpretative tools in the history of the development of mathematics into a general science of quantities. Special reference is made to Proclus’ commentary to Euclid’s first book of Elements , to the sixteenth century translations of Euclid’s work into Latin and to the works of Stevin, Wallis, Viète and Descartes. The prohibition rule on kind-crossing formulated by Aristotle in Posterior (...) analytics is used to distinguish between conceptions that share the same name but are substantively different: for example the search for a broader genus including all mathematical objects; the search for a common character of different species of mathematical objects; and the effort to treat magnitudes as numbers. Epistemic agents interact with evidence in different ways. This can cause trouble for mutual understanding and for our ability to rationally engage with others. Indeed, it can compromise democratic practices of deliberation. This paper explains these differences by appeal to a new notion: epistemic styles. Epistemic styles are ways of interacting with evidence that express unified sets of epistemic values, preferences, goals, and interests. The paper introduces the notion of epistemic styles and develops a systematic account of their nature. It (...) then discusses the implications of epistemic styles for central questions in epistemology, in particular, for issues surrounding rational engagement and for the debate between virtue epistemologists and epistemic situationists. Beliefs can be resistant to evidence. Nonetheless, the orthodox view in epistemology analyzes beliefs as evidence-responsive attitudes. I address this tension by deploying analytical tools on capacities and masking to show that the cognitive science of evidence-resistance supports rather than undermines the orthodox view. In doing so, I argue for the claim that belief requires the capacity for evidence-responsiveness. More precisely, if a subject believes that p, then they have the capacity to rationally respond to evidence bearing on p. Because (...) capacities for evidence-responsiveness are fallible and may be masked, beliefs can be held in the face of counter-evidence. Indeed, I will argue that our best science of belief supports the claim that evidence-resistant beliefs result from masks on evidence-responsiveness capacities. This account of belief not only allows for resistance to evidence, but provides us with a framework for describing and explaining actual cases of evidence-resistance. (shrink)

Cross-situational statistical learning of words involves tracking co-occurrences of auditory words and objects across time to infer word-referent mappings. Previous research has demonstrated that learners can infer referents across sets of very phonologically distinct words, but it remains unknown whether learners can encode fine phonological differences during cross-situational statistical learning. This study examined learners’ cross-situational statistical learning of minimal pairs that differed on one consonant segment, minimal pairs that differed on one vowel segment, and non-minimal pairs that differed on two (...) or three segments. Learners performed above chance for all pairs, but performed worse on vowel minimal pairs than on consonant minimal pairs or non-minimal pairs. These findings demonstrate that learners can encode fine phonetic detail while tracking word-referent co-occurrence probabilities, but they suggest that phonological encoding may be weaker for vowels than for consonants. This paper tackles the question of whether the order of concepts was still a relevant aspect of scientific rigour in the 19th and 20th centuries, especially in the case of authors who were deeply influenced by the Leibnizian project of a universal characteristic. Three case studies will be taken into account: Hermann Graßmann, Giuseppe Peano and Kurt Gödel. The main claim will be that the choice of primitive concepts was not only a question of convenience in modern hypothetico-deductive investigations, but (...) sometimes also the result of philosophical investigations onto the foundation of scienti­fic disciplines. The question of the "right" order of concepts is an ideal to be followed rather than a task that can be fulfilled, but remains nonetheless an essential part of the axiomatic enterprise. This paper aims to question whether there is in fact such a stark contrast, as there is often claimed to be in the literature, between the debates relating to the right order of concepts and the foundational questions concerning modern axiomatics. The scientific rupture determined by the appearance of hypothetico-deductive systems in mathema­tics and logic should thus not be dissociated from some relevant continuities concerning the ideal of knowledge as the search for a general theory of concepts deriving from some fundamental elements. Background: In the last decades, there have been important developments in the scientific and technological areas of healthcare. On certain occasions this provokes conflict between the patients' rights and the values of healthcare professionals which brings about, within this clinical relationship, the problem of conscientious objection. Aims: To learn the opinions that the Nurses of the Madrid Autonomous Community have regarding conscientious objection. Research design: Cross-cutting descriptive study. Participants and research context: The nurses of 9 hospitals and 12 Health Centers (...) in the Madrid Autonomous Community. The study was done by means of an auto completed anonymous questionnaire. The variables studied were social-demographical and their opinions about conscientious objections. Ethical considerations: The study was approved by the Ethical Community of Clinical Research of the University Hospital Príncipe de Asturias. Participants were assured of maximum confidentiality and anonymity. Findings: A total of 421 nurses answered the questionnaire. In total, 55.6% of the nurses confirmed they were religious believers, and 64.3% declared having poor knowledge regarding conscientious objection. The matters that caused the greatest objections were voluntary abortions, genetic embryo selection, refusal of blood transfusions, and therapy refusal. Discussion: Different authors state that the most significant cases of conscientious objections for health professionals are those regarding carrying out or assisting in abortions, euthanasia, the practice of assisted reproduction and, finally, the prescription and dispensing of the morning-after pill. In our study, the most significant cases in which the nurses would declare conscientious objections would be the refusal to accept treatment, the selection of embryos after genetic diagnosis preimplantation, the patient’s refusal to receive blood transfusions due to religious reasons and pregnant women’s request for voluntary abortions within the first 14 weeks. Conclusion: Nurses’ religious beliefs influence their opinions regarding conscientious objection. The nurses who declare themselves as religious believers object in a higher percentage than those without religious beliefs. (shrink)

SUMMARYThe essay argues that Jeremy Bentham played a major role in the transitional process between the eighteenth and the nineteenth centuries leading to the ‘discovery' or ‘invention of society' as an order, i.e., as an autonomous object of knowledge. By comparing Bentham's discourse with those developed by select protagonists of that transition, particularly Ferguson, Sieyès, and Mirabeau, it is shown how society emerges as the logical and historical space of a set of relationships that affects both the rationalisation and the (...) practice of government. In contrast with Michel Foucault's interpretation of Bentham's role in the genealogy of neoliberalism, recently developed by Pierre Dardot and Christian Laval, this paper suggests that ‘the new governmental reason’ rose from within the discourse of law. Consequently, the problem of ‘constitution’ was not left behind by the epistemological change of the eighteenth century, as they argue. Rather, the scientific and political understanding of society as a code became the base for an innovative conception of both law and politics. (shrink)

En distintos estudios que se ocupan del eufemismo se ha puesto de relieve la función que desempeñan las expresiones eufemísticas en el discurso político como herramientas de las que se sirve el emisor para ocultarle al destinatario aquellos aspectos desagradables o inoportunos que podrían dañar su imagen. Este artículo se fundamenta en una teoría pragmático-cognitiva del eufemismo y explica los efectos que produce en la mente de los hablantes un conjunto de expresiones eufemísticas empleadas en el discurso político español durante (...) los últimos años. En concreto, se propone la existencia de tres fenómenos que influyen en la representación mental de la realidad que construye el intérprete: el encuadre léxico, la obstrucción del acceso al referente y la estigmatización de conceptos. The dominating theologian in Europe between Thomas Aquinas and John Duns Scotus, Henry of Ghent produced a massive Summa of Ordinary Questions as well as fifteen quodlibets during his long tenure at the University of Paris. His work constituted a new synthesis of faith and reason which competed with that of Thomas Aquinas and influenced the history of both philosophy and theology. The first five articles of the Summa, dealing with various issues associated with human knowledge, constitute an adequate introduction (...) to Henry's thought. In them we find his approach to fundamental principles and themes developed in detail in the rest of his corpus. Of the five, only article one has appeared as a whole in English translation. The next four articles reinforce and develop the findings of the first article, providing additional treatments that indicate Henry's principles and orientation. In fact, these four articles alone provide a condensed but remarkably rich portrait of Henry's basic thought, and so are an invaluable resource for beginning and advanced students alike. Articles 2-5 include important positions on knowledge and reality, a conception of humanity's ultimate purpose and the pursuits most conducive to it, and an approach to faith and reason. These four articles are presented here for the first time in English translation with an introduction and notes. Bergson's engagement with evolutionary theory was remarkably up to date with the science of his time. One century later, the scientific and social landscape is undoubtedly quite different, but some of his insights remain of critical importance for the present. This paper aims at discussing three related aspects of Bergson's philosophy of evolution and their relevance for contemporary debates: first, the stark distinction between the affirmation of the reality of change and becoming, on the one hand, and any notion of (...) progress on the other; second, the insistence on the intimate interplay between forms of knowledge and forms of life; third, his idea that machines and organisms, technology and biology, are not separate domains but, rather, stem from and answer to the same problems and needs that living beings express. Such a Bergsonian framework may prove very helpful in reassessing the implicit assumptions of several contemporary debates on the ethical and political stakes of evolution, biosciences, and technologies, as well as the increasingly problematic boundary between “biology” and “culture.”. BackgroundInformed consent forms for clinical research are several and variable at international, national and local levels. According to the literature, they are often unclear and poorly understood by participants. Within the H2020 project CORBEL—Coordinated Research Infrastructures Building Enduring Life-science Services—clinical researchers, researchers in ethical, social, and legal issues, experts in planning and management of clinical studies, clinicians, researchers in citizen involvement and public engagement worked together to provide a minimum set of requirements for informed consent in clinical studies.MethodsThe template was (...) based on a literature review including systematic reviews and guidelines searched on PubMed, Embase, Cochrane Library, NICE, SIGN, GIN, and Clearinghouse databases, and on comparison of templates gathered through an extensive search on the websites of research institutes, national and international agencies, and international initiatives. We discussed the draft versions step-by-step and then we referred to it as the “matrix” to underline its modular character and indicate that it allows adaptation to the context in which it will be used. The matrix was revised by representatives of two international patient groups.ResultsThe matrix covers the process of ensuring that the appropriate information, context and setting are provided so that the participant can give truly informed consent. It addresses the key topics and proposes wording on how to clarify the meaning of placebo and of non-inferiority studies, the importance of individual participants’ data sharing, and the impossibility of knowing in advance how the data might be used in future studies. Finally, it presents general suggestions on wording, format, and length of the information sheet.ConclusionsThe matrix underlines the importance of improving the process of communication, its proper conditions (space, time, setting), and addresses the participants’ lack of knowledge on how clinical research is conducted. It can be easily applied to a specific setting and could be a useful tool to identify the appropriate informed consent format for any study. The matrix is mainly intended to support multicentre interventional randomized clinical studies, but several suggestions also apply to non-interventional research. (shrink)

The orthodox view in epistemology is that belief is constitutively evidence-responsive. I offer a novel argument for a version of this view, one that appeals to capacities to rationally respond to evidence. I do so by developing the Sellarsian idea that the concept of belief functions to mark the space of reasons in a non-intellectualist and naturalistic direction. The resulting view does justice to the role of belief in social interactions, joint deliberation, and rational persuasion, while including evidence-resistant beliefs and (...) animal beliefs as genuine beliefs. It has a range of further benefits: it helps us account for epistemic normativity, paves the way for better psychological models of belief revision, distinguishes beliefs from imaginings and mere acceptances, and helps us avoid noxious simplistic takes on human irrationality. Delusions are standardly defined as attitudes that are not amenable to change in light of conflicting evidence. But what evidence do people with delusion have for and against it? Do delusions really go against their total evidence? How are the answers affected by different conceptions of evidence? -/- This chapter focuses on how delusions relate to evidence. I consider what delusions-relevant evidence people with delusions have. I give some reasons to think that people typically have evidence for their delusions, and (...) that the evidence they have against them is often overstated. I draw on this discussion to consider whether delusions are evidentially supported and epistemically rational. Finally, I discuss implications for the nature of delusion, responsibility, and treatment and suggest directions for future research. Throughout, the discussion is sensitive to different conceptions of evidence and rationality in epistemology. -/- A central upshot is that what we should say about the epistemic standing of delusions depends substantively on our positions in epistemology, in particular, on the debate between internalists and externalists about evidence. If we want clarity on the epistemic standing of delusions, we need to incorporate more sophisticated tools from epistemology. (shrink)

In a time of globalization, Political Philosophy for the Global Age provides a theoretical basis for the convergence of human values in terms of legitimate conceptions of time, language, and notions of self. Sánchez Flores reviews what she considers to be the most important positions in the current debate on political theory (liberalism, communitarianism, feminism, and postcolonialism) and also proposes her own original contribution. Sánchez Flores’s unique approach is a critique of a type of morality formulated solely on (...) the basis of the Judeo-Christian view of reality. It is a theoretical construct that becomes an invitation to explore other notions of human morality and an inquiry into the need to produce a political philosophy that universalizes an ethics of caring and responsibility as well as provides a locus where diverse human cultures can meet. This thesis makes two claims: first, that conflict is constitutive of human agency, and second, that this understanding of agency in terms of conflict makes politics a problem about the will. I develop an argument to show how these two claims weave together to create the fabric of Kant’s account of political willing. From this Kantian approach to conflict and agency, the systematic question animating this thesis thereby arises: what are the conditions that make political willing possible? This thesis defends (...) the notion of political willing as a placeholder for a number of inter-woven conditions that make political life in common possible. As a form of rightful interaction between free agents of choice, this form of willing emerges in Kant from the constitutive features of what it means to be an agent in a world with others agents. This relation between agents makes conflict unavoidable, a conflict which only a will that is public, omnilateral, and coercive, can rightfully resolve. I trace the development of this model of political willing in three spheres of Kant’s thought: individual ethics, teleology, and politics. I conclude that Kant’s view of politics is, in some ways, more Hobbesian than Hobbes’: for Kant, conflict cannot and should not be fully eradicated, if we are to take seriously equality between agents. Life under the state is not conflict-free, but rather it is a sphere made to preserve and to safeguard the boundaries of a shared political life, always prone to conflict. (shrink)

In this article, I examine the conceptual and methodological points of convergence and divergence of two intellectual currents frequently referred to as the decolonial and ontological turns in social and anthropological theory. Salient points considered are the ways both theoretical projects unsettle modernity’s dominant ontological and epistemological foundations by seriously engaging the conceptual potential of thinking with alterity (ethical dimension) and from exteriority (geopolitical dimension). I compare their subversive methodological contributions, examining, in particular, Enrique Dussel’s analectical hermeneutic approach and Eduardo (...) Viveiros de Castro’s ethnographic method of controlled equivocation. Lastly, I discuss how both theories and approaches complement each other’s efforts to destabilize Western modernity’s philosophical and anthropological foundations. (shrink)

Interpretations of Einstein’s equation differ primarily concerning whether E = mc2 entails that mass and energy are the same property of physical systems, and hence whether there is any sense in which mass is ever ‘converted’ into energy. In this paper, I examine six interpretations of Einstein’s equation and argue that all but one fail to satisfy a minimal set of conditions that all interpretations of physical theories ought to satisfy. I argue that we should prefer the interpretation of Einstein’s (...) equation that holds that mass and energy are distinct properties of physical systems. This interpretation also carries along the view that while most cases of ‘conversion’ are not genuine examples of mass being ‘converted’ into energy, it is possible that the there are such ‘conversions’ in the sense that a certain amount of energy ‘appears’ and an equivalent of mass ‘disappears’. Finally, I suggest that the interpretation I defend is the only one that does not blur the distinction between what Einstein called ‘principle’ and ‘constructive’ theories. This is philosophically significant because it emphasizes that explanations of Einstein’s equation and the ‘conversion’ of mass and energy must be top‐down explanations. (shrink)

This article comprises an up-to-date critical review of the field known as Economic Methodology or Philosophy of Economics (EM/PE). Two edited volumes (Kincaid and Ross 2021; Heilmann and Reiss 2021), a special issue of the Journal of Economic Methodology (2021), and a recent bibliometric analysis of the field (Claveau et al. 2021) constitute the basis of the review. Drawing on these sources, we identify a number of problematic trends in current EM/PE research. We claim that these trends could be interpreted (...) as two kinds of biases, namely a micro-level bias and a mainstream bias. We discuss the respective details of these biases and their normative implications for the discipline. (shrink)
